No, weed is not legal in Bosnia and Herzegovina, and the answer to what happens if you are caught with it depends on which part of the country you are in. Possession for personal use is a criminal offence in the Federation of Bosnia and Herzegovina and a misdemeanour punishable by a fine in Republika Srpska.

Medical cannabis was rescheduled at state level at the end of 2025, which was widely reported abroad as legalisation, but no patient can legally obtain it. This guide explains all of that.

Is weed legal in Bosnia for recreational use?

Recreational weed is illegal throughout Bosnia and Herzegovina. What varies is the legal machinery, because of how the country is structured.

Scheduling, meaning which substances are controlled, is decided at state level by the Council of Ministers. Criminal law is not: it sits with the two entities, the Federation of Bosnia and Herzegovina and Republika Srpska, and with the Brčko District. So the substance is controlled everywhere, but the offence you commit and the penalty you face are entity matters.

An April 2024 bill in the Federation would have decriminalised possession of up to four grams. It was never adopted, and the position described below is the current one.

Is medical marijuana legal in Bosnia?

This is the part most English-language coverage gets wrong. On 29 December 2025 the Council of Ministers took a decision rescheduling cannabis from Table I to Table II of the list of controlled substances, the category that recognises accepted medical use. That decision was reported internationally as “Bosnia legalizes medical cannabis”.

It is more accurate to say that Bosnia removed one obstacle. As of September 2026:

  • No parliament, at state or entity level, has passed a medical cannabis law.
  • No cannabis-based medicine is registered for use in the country.
  • No prescribing rules, patient eligibility criteria or dispensing framework have been published.
  • No patient can lawfully obtain medical cannabis.

Possession also remains a criminal offence in the Federation, which the FBiH Ministry of Justice confirmed in June 2026, some six months after the rescheduling decision. A patient in Sarajevo who obtains cannabis for a medical reason today is committing the same offence as anyone else.

Rescheduling is a real and necessary step, and it is the precondition for a programme rather than the programme itself. If you are reading this because you saw a headline, the honest summary is that Bosnia has changed a classification, not created access.

What are the penalties under Bosnia weed laws?

Penalties under Bosnia weed laws split along the entity line, and the difference between the two is the single most useful thing to know.

In the Federation of Bosnia and Herzegovina, possessing a narcotic drug for personal use is a criminal offence under the Criminal Code of the Federation, carrying up to one year’s imprisonment. A court can impose a fine instead, and in practice often does for small amounts, but the conviction is a criminal one and it goes on a criminal record. That covers Sarajevo, Mostar, Tuzla, Zenica and Bihać.

In Republika Srpska, the same conduct is dealt with as a misdemeanour under public order legislation and punished with a fine. No criminal record follows. That covers Banja Luka, Trebinje and the eastern approach to Sarajevo.

Brčko District is reported to follow the Republika Srpska approach, but we have not been able to confirm that from a primary source and would not rely on it.

Selling, supplying, producing and trafficking are serious criminal offences in both entities, with substantially heavier sentences, and nothing about the entity difference applies to them. The split is about personal possession only.

Is CBD legal in Bosnia?

Bosnia’s CBD position is genuinely unresolved, and that is the accurate answer rather than a hedge.

Before December 2025 there was no framework permitting CBD consumer products and no published THC threshold for them. The rescheduling decision changed cannabis’s classification but did not, so far as can be established, create a hemp or low-THC carve-out or set a limit for CBD products.

No regulator has published guidance on what the decision means for CBD oils, cosmetics or supplements.

CBD products are sold in shops in both entities. That reflects the absence of enforcement rather than the presence of a permission, and it is not a safe basis on which to import anything.

Can you smoke weed in Bosnia as a tourist?

No, and a visitor is more exposed to the entity difference than a resident, because a single trip can easily cross it.

Bosnia is small and the entity boundary is not signposted in the way an international border is. A day that starts in Banja Luka and ends in Sarajevo has moved from a jurisdiction where personal possession is a fine to one where it is a criminal charge, with no obvious marker in between. Do not assume that what you were told in one town holds in the next.

Nothing about the December 2025 medical rescheduling gives a tourist any standing. If you hold a medical cannabis prescription from another country, there is no recognition route in Bosnia and no registered product to be dispensed against it. Check with the Bosnian embassy in your country before travelling rather than relying on the headlines.

The bottom line on cannabis in Bosnia

Weed is illegal across Bosnia and Herzegovina, but personal possession is a criminal offence in the Federation and a fineable misdemeanour in Republika Srpska, so where you are standing changes the outcome.

Medical cannabis was rescheduled in December 2025 without a law, a registered product or any route for patients to obtain it, so treat “Bosnia legalised medical cannabis” as a headline rather than a description. CBD sits in an unresolved gap. Supply and trafficking are treated seriously everywhere.
