No, recreational weed is not legal in Ukraine, but medical cannabis is. A law legalising cannabis-based medicines took effect in August 2024, and the first patients received them on prescription in June 2026.
Possessing cannabis without a prescription remains an offence: small amounts are dealt with under administrative law, larger amounts under the Criminal Code. This guide explains Ukraine’s cannabis laws, the medical programme, penalties, CBD and the travel position.
Is weed legal in Ukraine for recreational use?
Recreational weed is illegal in Ukraine. The medical cannabis law that came into force on 16 August 2024 covers medical use only and does not legalise recreational use.
Possession outside the medical system is still prohibited. Ukrainian law separates small amounts, which fall under Article 44 of the Code of Administrative Offences, from larger amounts, which fall under Article 309 of the Criminal Code.
The exact quantity that separates the two should be checked before relying on any figure.
There is no legal market, no social club and no home-grow allowance.
What are the penalties under Ukraine weed laws?
Penalties under Ukraine weed laws depend on the amount and the purpose. A small amount for personal use is an administrative offence.
Larger amounts move the case into criminal law under Article 309 of the Criminal Code.
The US State Department summarises the risk. It says penalties for possessing, using or trafficking illegal drugs are severe, and that convicted offenders can expect long jail sentences and heavy fines.
Penalties at a glance
| Conduct | Governing law | General outcome |
|---|---|---|
| Small amount for personal use | Code of Administrative Offences, Art. 44 | An administrative offence |
| Larger amount | Criminal Code, Art. 309 | A criminal offence |
| Prescribed medical cannabis | Law No. 3528-IX | Legal for patients with a prescription |
Is medical marijuana legal in Ukraine?
Yes. Law No. 3528-IX, which took effect on 16 August 2024, allows cannabis-based medicines for patients for whom standard treatments have not worked. The Ministry of Health has published the list of conditions that qualify.
Medicines are available only on electronic prescription and are sold only through pharmacies. The first cannabis-based products were entered into the state register in January 2025, and the first patients received them in Vinnytsia on 11 June 2026.
Licensed cultivation is tightly controlled. It must take place indoors, with round-the-clock video surveillance that the National Police can access. Patients currently pay for the medicines themselves.
Is CBD legal in Ukraine?
The position on CBD products is not clearly settled in Ukraine. The medical cannabis law regulates cannabis-based medicines, but no official guidance confirms which consumer CBD products, if any, can be sold freely.
Treat CBD with caution. A CBD product bought abroad could be tested and treated as a cannabis product, so leave it at home unless you have checked the current rules.
Can you smoke weed in Ukraine as a tourist?
No. Visitors are subject to the same law as Ukrainians, and the medical programme is not a route for tourists. The law does allow travellers to carry cannabis-based medicines, but only in the amount set by a doctor’s prescription.
The first question for most visitors is whether to travel at all. The UK Foreign Office advises against all travel to parts of Ukraine and all but essential travel to other parts, in its Ukraine travel advice. It says penalties for possession of drugs are severe.
The US State Department rates Ukraine at Level 4, Do Not Travel.
The bottom line on cannabis in Ukraine
Recreational weed is illegal in Ukraine, with small amounts handled as administrative offences and larger amounts prosecuted under the Criminal Code. Medical cannabis has been legal since August 2024, with electronic prescriptions, pharmacy-only sales and the first patients treated in June 2026.
CBD has no clearly settled consumer status. Given the war and the drug laws, visitors should avoid cannabis entirely.
