El Salvador has no personal-use allowance, and the state of exception in force since 2022 has weakened protections for anyone arrested. This guide explains El Salvador’s weed laws, the penalties, CBD and the risks for tourists.
Is weed legal in El Salvador for recreational use?
Recreational weed is illegal in El Salvador. Cannabis is controlled under the Law Regulating Drug-Related Activities, Legislative Decree 153 of 2003, which allows controlled substances only for authorised research, medicine and industry.
There is no carve-out for personal use and no tolerated quantity. The country’s drug observatory, part of the Ministry of Justice and Security, has stated that consuming any marijuana product, whether cannabis or hemp, is illegal in El Salvador.
No legal market exists. A 2019 proposal to allow therapeutic cannabis was sent to committee and has not become law.
What are the penalties under El Salvador weed laws?
Penalties under El Salvador weed laws start with prison for any amount. Article 34 of the drug law sets the tiers by weight, and every tier carries prison.
Possessing less than two grams carries one to three years in prison. Two grams or more carries three to six years. If the possession is intended for trafficking, the range rises to six to ten years.
Trafficking itself carries ten to fifteen years. Planting or cultivating cannabis carries five to fifteen years. In practice, that means even a single joint can lead to a sentence measured in years.

Is medical marijuana legal in El Salvador?
No. Medical marijuana is not legal in El Salvador, and there is no programme, patient registry or prescribing route. The national drug observatory has said that no cannabinoid product has been authorised for medicinal use.
The drug law does allow controlled substances to be used for medical treatment with the regulator’s authorisation. No such authorisation exists for cannabis, so the provision has no practical effect for patients.
Is CBD legal in El Salvador?
No, in practice CBD is not legal in El Salvador. The US State Department states that items containing THC, including most CBD products, are illegal, and that offenders can expect long jail sentences and heavy fines.
The drug observatory’s warning covers hemp as well as cannabis, so a low-THC label offers no protection. Do not bring CBD oils, gummies or vapes into the country.
Can you smoke weed in El Salvador as a tourist?
No. Tourists are prosecuted under the same law as Salvadorans, and the prison tiers apply from the first gram. There is no tourist allowance and no tolerated setting.
The UK Foreign Office says in its El Salvador travel advice that there are severe penalties for drug use and trafficking, and that prisons are overcrowded and violent.
The state of exception adds a further layer of risk. It was introduced in March 2022 against gangs, not as a drug measure, and has been extended repeatedly since. The State Department notes it has suspended some constitutional rights, including the right to a speedy trial and access to counsel. Anyone arrested, including for a drug offence, may find those protections unavailable.
