Is Weed Legal in Vatican City

No, weed is not legal in Vatican City. The world’s smallest state has its own drug law, adopted in 2013, which makes it a crime to grow, sell or hold any narcotic without authorisation.

Even an amount clearly meant for personal use can bring up to a year in prison. Because every visitor arrives through Rome, Italian law matters too. This guide explains Vatican City’s cannabis laws, the penalties, the medical and CBD position, and what visitors to St Peter’s should know.

Is weed legal in Vatican City for recreational use?

Recreational cannabis is illegal in Vatican City. Since 1 September 2013, drug offences have been set out in Law No. VIII of 2013, the Vatican’s supplementary criminal law. Its section on narcotic and psychotropic substances covers every drug listed in the UN drug conventions, and cannabis is treated like any other.

The Vatican’s legal system is unusual. Canon law is its first source of law, and Italian laws apply only to fill gaps after a Vatican authority has adopted them. On drugs, there is no gap to fill, because the Vatican has written its own offences.

There is no legal market, no tolerated amount and no exception for private use.

What are the penalties under Vatican City weed laws?

Penalties under Vatican City’s drug laws start with possible prison even for personal use. Under Article 42 of Law No. VIII, holding drugs intended exclusively for personal use is punished with one month to one year in prison and a fine of up to 1,000 euros.

Supplying drugs is treated far more seriously. Growing, producing, selling or supplying narcotics without authorisation carries six to twenty years in prison and heavy fines, with lower ranges for minor cases. Penalties increase where minors or large quantities are involved.

That is stricter than many visitors expect. In the Vatican, personal use remains a criminal offence with a possible prison term.

Is medical marijuana legal in Vatican City?

There is no medical cannabis framework in Vatican City. The drug law does exempt pharmacies that buy controlled drugs and supply them as medicines on a doctor’s prescription, but no cannabis-specific medical scheme has been published.

For a visitor carrying prescribed medical cannabis, the practical question is Italian law, because the journey begins and ends in Rome. Check the Italian rules for travelling with prescribed cannabis before you go.

Is CBD legal in Vatican City?

No dedicated CBD rules exist in Vatican City. The drug law makes no special provision for CBD or hemp.

The simplest advice is not to bring CBD products into Vatican City. If you are carrying them in Rome, the relevant rules are Italy’s.

Can you smoke weed at the Vatican as a tourist?

No. Visitors are subject to the Vatican’s drug law on its territory, and St Peter’s Square is part of Vatican City. Under the 1929 Lateran Treaty, the square stays open to the public but is policed by the Italian authorities.

The treaty also provides for Italy to punish crimes committed in Vatican City when the Holy See asks it to. A visitor caught with cannabis on the square is therefore likely to be dealing with Italian police, not only Vatican rules.

The UK Foreign Office covers Vatican City within its Italy travel advice. It warns that illegal drugs, including cannabis, carry severe penalties, and that you should expect a long jail sentence and heavy fines for possessing, using or smuggling them.

The bottom line on cannabis in Vatican City

Cannabis is illegal in Vatican City under its own 2013 drug law. Even a personal-use amount can bring one month to a year in prison, and supply carries six to twenty years.

There is no medical cannabis scheme and no CBD framework. St Peter’s Square is Vatican territory policed by Italy, so visitors should leave cannabis well away from the Vatican and check Italian law for the rest of their trip.
