Is Weed Legal in Lithuania

No, weed is not legal in Lithuania, and the detail that catches people out is that possession is a criminal matter at any quantity. Lithuania is one of the stricter European Union countries on cannabis, not one of the more relaxed ones, and repeated attempts to soften the law have all failed.

Medical cannabis is lawful in principle but effectively unavailable, and CBD food products cannot be sold at all. This guide explains Lithuania’s cannabis laws, the penalties, the medical position and what visitors should expect.

Is weed legal in Lithuania for recreational use?

Recreational weed is illegal in Lithuania and there is no decriminalised amount. The offences sit in the Criminal Code, which separates handling cannabis without intent to supply from handling it with intent to supply, and grades both by quantity.

The point most English-language sources get wrong is the status of small amounts. Holding a small quantity for your own use is not an administrative matter in Lithuania.

It is a criminal misdemeanour, which means no prison sentence is available but a criminal record is. The European Union Drugs Agency places Lithuania in the criminal category for cannabis use and possession in its comparison of how EU countries respond to cannabis.

There is one genuine split worth understanding. Consuming a drug without a prescription is handled as an administrative offence carrying a fine. Possessing it is criminal. So Lithuanian law is, oddly, harsher about holding cannabis than about having consumed it.

This position dates to 2017. When Lithuania replaced its old code of administrative violations that year, the administrative route for personal possession was not carried across, which left the criminal provision as the only one available. Several attempts to reverse that have been made since and all have failed, most recently stalling in committee.

What are the penalties under Lithuania weed laws?

Penalties under Lithuania weed laws turn on two questions: the quantity involved, and whether you intended to pass it on. Those two answers between them decide whether you face a fine or a long prison sentence.

For a small quantity held without intent to supply, the available penalties are community service, a fine, restriction of liberty or short detention. Imprisonment is not an option at this tier, but the conviction is criminal. Above the small-quantity line, still without intent to supply, imprisonment becomes available.

Once intent to supply is established, the exposure rises steeply, and it rises again for large and especially large quantities. At the top of the scale the sentences are measured in many years. There is a structural trap worth knowing: at the very highest quantity band, intent to supply is not required at all, so possession alone is enough.

Lithuania fixes its quantity thresholds by ministerial order rather than in the Criminal Code itself, and measures them by pure active substance rather than by the weight of the material.

That arrangement is currently the subject of a legal challenge before the Supreme Administrative Court, on the argument that criminal liability should not depend on a ministerial instrument. No decision had been published as of September 2026.

There is one route out. A person who voluntarily surrenders drugs, or who approaches a healthcare institution for help, is exempt from criminal liability for possession without intent to supply.

Is medical marijuana legal in Lithuania?

Medical cannabis has been lawful in Lithuania since 2019, but lawful and available are not the same thing, and in practice patients have very little access.

The 2019 amendment allows a prohibited substance to be used for healthcare purposes only where it forms part of an authorised medicinal product, either registered nationally or authorised across the European Union. Supply runs through licensed legal entities and dispensing is by pharmacy on a narcotic prescription.

What the framework does not provide is a cannabis programme in the sense most readers mean. There is no patient register, no dispensary, no cannabis flower and no domestic cultivation for medical purposes. Industry reporting indicates that no product marketing authorisation has been granted and no patients have been treated under the national route.

Is CBD legal in Lithuania?

CBD is not legal to sell as a food or food supplement in Lithuania, and the position is stricter than in much of the European Union.

The State Food and Veterinary Service states that food products containing hemp extracts or derived components such as cannabidiol cannot be supplied to the Lithuanian market. Its reasoning is that these are novel foods requiring authorisation under EU rules, and no such authorisation has been granted.

Note what is not being said. Lithuania does not treat CBD itself as a narcotic. It is the novel food rule, applied strictly and without the tolerance shown elsewhere, that blocks the market. A separate rule sets a zero THC limit for electronic cigarettes, refill containers and herbal smoking products.

Industrial hemp is lawful to grow under licence at up to 0.3% THC, in line with the EU agricultural limit.

Can you smoke weed in Lithuania as a tourist?

No, and Vilnius being a popular weekend destination changes nothing about the law. Visitors are prosecuted under the same Criminal Code as residents, and there is no tolerated amount, no coffee shop model and no distinction between a rented apartment and the street.

The UK Foreign, Commonwealth and Development Office states in its Lithuania travel advice that illegal drugs including cannabis are strictly prohibited even in very small quantities, and that severe penalties apply for possessing, using, buying or smuggling them, including when transiting through airports.

Transit matters here. Lithuanian airports scan the baggage of all passengers, including those merely changing planes, so a connection through Vilnius places a traveller inside Lithuanian jurisdiction.

The bottom line on cannabis in Lithuania

Weed is illegal in Lithuania, possession is criminal at any quantity, and the small-quantity tier avoids prison but not a criminal record. Medical cannabis is lawful on paper and unavailable in practice, CBD cannot be sold as food, and hemp is limited to 0.3% THC under licence.

Repeated reform attempts have failed and nothing is currently close to passing, though a legal challenge to how the quantity thresholds are set is live. For a visitor, the safe assumption is zero tolerance.
