Weed is not legal in Ecuador, but personal consumption is not a crime, which is why the question of whether marijuana is legal in Ecuador causes so much confusion.
The Constitution treats drug use as a public-health issue, and the Penal Code says possession for personal consumption is not punishable.
What has changed is the limit: the old 10-gram table for marijuana was repealed in 2023, and no replacement figure has been issued. Medical cannabis and low-THC hemp are legal.
This guide explains Ecuador’s cannabis laws, the missing threshold, penalties, CBD and the risks for visitors.
Is weed legal in Ecuador for recreational use?
Recreational weed is not legal in Ecuador. There are no shops, no legal sales and no licensed recreational growers. Selling or supplying cannabis is a crime.
Consumption is treated differently. Article 364 of the Constitution frames addiction as a public-health problem and rules out criminalising it. The Constitutional Court confirmed in 2019 that drug use is a health matter rather than a crime.
Article 228 of the Organic Integral Penal Code, known as the COIP, says possession for personal consumption is not punishable.
The difficulty is proving that an amount is for personal consumption. That question used to be answered by a table of maximum quantities, and that table no longer exists.
What happened to Ecuador’s 10-gram limit?
For a decade, a 2013 resolution set maximum quantities for personal use, including 10 grams of marijuana. Executive Decree 28 repealed that table, with effect from 24 November 2023.
In June 2025, the National Assembly passed the Organic Law on National Solidarity, which reformed Article 228.
It says the parameters for personal consumption will be set by a joint resolution of the Health Ministry, the Prosecutor’s Office and the Judicial Council. No such resolution has been found, which leaves police, prosecutors and judges to decide case by case.
What are the penalties under Ecuador weed laws?
Penalties under Ecuador weed laws fall on anything beyond personal consumption. Trafficking is prosecuted under the COIP and carries prison terms.
Without a gram table, the line between a consumer and a suspected dealer is less clear than it was. The 10-gram figure that still appears in many online guides is no longer law, and relying on it could be a costly mistake.
The US State Department describes the penalties for possessing, using or trafficking illegal drugs in Ecuador as severe. It says offenders can expect long jail sentences and heavy fines.
Penalties at a glance
| Conduct | Governing law | General outcome |
|---|---|---|
| Possession for personal consumption | Constitution Art. 364; COIP Art. 228 | Not punishable, but no fixed gram limit currently applies |
| Possession judged to exceed personal use | COIP | Can be prosecuted as trafficking |
| Selling, supplying or trafficking | COIP | Prison |
| Licensed hemp under 1% THC | Agriculture ministry licensing | Lawful for licence holders |
Is medical marijuana legal in Ecuador?
Yes. In September 2019, the National Assembly approved reforms to the COIP allowing the medicinal and therapeutic use of cannabis derivatives. That change separated medical products from the general drug prohibition.
How patients actually obtain products depends on health-ministry rules, which should be checked before relying on any specific route. What is settled is that medical cannabis has a legal basis in Ecuador that recreational use does not.
Is CBD legal in Ecuador?
CBD can be legal in Ecuador when it comes from licensed hemp. The agriculture ministry defines non-psychoactive cannabis, or hemp, as cannabis with less than 1% THC by dry weight, and it licenses cultivation and processing under a 2020 ministerial agreement.
The ministry’s hemp guidance sets out seven licence types for that industry. Rules for selling finished CBD foods or cosmetics to consumers are separate, so buy only from established sellers.
Can you smoke weed in Ecuador as a tourist?
You should not. The personal-consumption rule does not make buying cannabis legal, because the seller is committing a crime, and the lack of a gram limit gives the authorities wide discretion.
The UK Foreign Office says the penalties for drug trafficking or drug use are harsh, and that prison conditions are very basic. It advises against all but essential travel to parts of Ecuador, and warns separately about DMT-containing substances sold as spiritual cleansing.
The US State Department rates Ecuador at Level 2, Exercise Increased Caution. Its warning about long jail sentences applies to visitors in the same way as residents.
The bottom line on cannabis in Ecuador
Weed is not legal in Ecuador, but personal consumption is not punishable under the Constitution and the Penal Code. The 10-gram limit was repealed in 2023 and no new figure has been set, so the line between user and dealer is decided case by case.
Medical cannabis and hemp under 1% THC are legal. Visitors should not rely on the personal-use protection, because the risks of getting it wrong are serious.
