No, weed is not legal in Moldova. Cannabis is a controlled narcotic and there is no legal recreational market. Moldova does split its approach, though: a genuinely small amount is dealt with as an administrative offence carrying a fine rather than as a crime, while anything above that threshold is criminal.

That is decriminalisation in a narrow technical sense, not legalisation. This guide explains Moldova’s cannabis laws, the penalties, the hemp rules that changed recently, and the separate question of Transnistria.

Is weed legal in Moldova for recreational use?

Recreational weed is illegal in Moldova. Cannabis sits on the prohibited list of narcotic substances, and the framework statute governing narcotics, psychotropic substances and precursors is Law No. 201 of 10 July 2025, published on the official legislative portal.

Two separate codes create the offences. The Contravention Code covers acquiring or holding a small quantity without intent to supply, and consuming without a prescription, as administrative matters. The Criminal Code covers larger quantities, separating those held without intent to supply from those held with it.

The quantities that mark these boundaries are fixed by government decision rather than by the codes themselves. One practical detail matters: Moldovan forensic practice measures the total weight of the material seized rather than its pure THC content, so the gross weight is what determines which track you are on.

There is no tolerated retail scene, no social club model and no cannabis available legally for recreational use.

What are the penalties under Moldova weed laws?

Penalties under Moldova weed laws depend entirely on quantity and on whether supply was intended. The dividing line between an administrative fine and a criminal conviction is quantity, and it is drawn low.

For a small quantity held without intent to supply, or for consuming without a prescription, the outcome is administrative: a fine, or unpaid community work of up to 72 hours. No criminal record follows. Published official figures for the fine range are inconsistent between sources, so treat any specific number you see with caution.

Above that threshold, the Criminal Code applies and the consequence is a custodial sentence, rising sharply with the quantity band and again where supply was intended. Illegal cultivation is handled as a contravention at small scale and criminally at larger scale.

Moldova’s own reporting indicates that possession-type cases dominate the caseload rather than supply cases, which fits a picture of enforcement aimed largely at users. Enforcement is real: official 2024 data records more than 34 kilograms of marijuana seized.

There is one statutory way out. Liability is waived where a person voluntarily surrenders the drugs or approaches a medical service for help, and the Criminal Code contains a parallel provision for voluntary surrender with cooperation.

Is medical marijuana legal in Moldova?

Medical marijuana is not legal in Moldova and there is no route for a patient to obtain it. Cannabis sits on the prohibited list, and the 2025 framework law permits controlled circulation only for substances in the lower schedules, which does not include it.

The same law defines industrial hemp in a way that expressly excludes medical, recreational and experimental use, which closes the door from the other direction too. No medical cannabis bill was before the Moldovan parliament as of September 2026.

Is CBD legal in Moldova?

There is no published Moldovan position on CBD consumer products such as oils, edibles or vapes. They are neither expressly authorised nor expressly banned, and this is a genuine gap rather than a settled rule.

What Moldova has done is legalise and regulate industrial hemp, and that is the real development of the last two years. The 2025 framework law defines industrial and horticultural hemp as cannabis containing no more than 0.3% THC, verified by accredited laboratory analysis, grown for industrial, horticultural or food purposes.

A government regulation approved in April 2026 then set out the licensing machinery. The national food safety agency issues cultivation authorisations and carries out inspections, only catalogued varieties may be grown, and the permitted outputs were widened to include fibre, seed, oil, food supplements and cosmetics. Around 600 hectares were expected to be sown in 2026.

That hemp framework is the closest thing to a signal on CBD, and it stops well short of an answer. Do not assume a CBD product is admissible.

Can you smoke weed in Moldova as a tourist?

No. Visitors are treated the same as residents, and neither of the major English-language travel advisories mentions the small-quantity administrative route at all, which is a useful hint about what to expect in practice.

The UK Foreign, Commonwealth and Development Office states in its Moldova travel advice that illegal drugs including cannabis carry severe penalties, that travellers should expect a long jail sentence and heavy fines, and that this applies when transiting through the airport. The US State Department warns that travellers who have broken local laws have faced pre-trial detention lasting years.

Transnistria needs separate mention. The Moldovan government does not exercise control on the ground in the region on the left bank of the Nistru, which operates its own de facto legal and enforcement system.

Nothing in Moldova’s administrative small-quantity route can be assumed to apply there, and both the UK and the US warn against or advise reconsidering travel, noting that consular assistance is extremely limited.

Weed is illegal in Moldova, with a small-quantity administrative route that stops well short of legalisation and a criminal track above it.

There is no medical programme and no bill. CBD consumer products have no published status, though industrial hemp is now licensed at up to 0.3% THC and a real cultivation sector is being built. Transnistria is outside Moldovan control and should be treated as a separate risk entirely. For a visitor, the safe assumption is that cannabis brings a fine at best and a prosecution at worst.
